1. Seller
SANI WHOO
Owner: Sanaz Hughes
Schildgenweg 21
51149 Cologne
Germany
Email: hallo@saniwhoo.com
(hereinafter referred to as the “Seller”)
2. Scope of Application
These Terms and Conditions apply to all contracts concluded between the Seller and customers for the sale of goods via the online shop at www.saniwhoo.com.
The offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB).
Individual agreements shall take precedence over these Terms and Conditions.
3. Subject of the Contract
The Seller offers jewelry items and gift vouchers that are individually produced based on the information provided by the customer.
Delivery is carried out via a shipping service provider to the delivery address specified by the customer.
4. Conclusion of Contract
The products presented in the online shop do not constitute a legally binding offer, but an invitation to place an order.
By completing the ordering process, the customer submits a binding offer to purchase the goods contained in the shopping cart.
The contract is concluded once the Seller accepts the order by sending an order confirmation via email.
Payment is due immediately upon conclusion of the contract.
5. Prices and Payment
All prices listed are total prices.
In accordance with Section 19 of the German Value Added Tax Act (UStG), no VAT is charged (small business regulation).
Any additional shipping costs will be displayed separately during the ordering process.
The available payment methods are shown at checkout.
6. Delivery and Shipping
Delivery is made to the delivery address specified by the customer.
Delivery within Germany usually takes 2–5 business days, unless otherwise stated in the respective product description.
Applicable shipping costs will be displayed during the ordering process.
If a return occurs for reasons attributable to the customer (e.g. an incorrect delivery address), the customer shall bear the costs of reshipping.
7. Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal.
The right of withdrawal does not apply to personalized jewelry items that are made according to customer specifications or clearly tailored to personal needs (Section 312g para. 2 no. 1 BGB).
Details regarding the right of withdrawal and how to exercise it are set out in the separate withdrawal policy, which forms an integral part of the contract.
8. Voluntary Courtesy Policy (Voucher & Adjustment)
Independently of the statutory right of withdrawal, the Seller may, as a gesture of goodwill, offer an exchange for personalized jewelry items in the form of a voucher.
The exchange may be requested within 30 days of receipt.
The voucher generally corresponds to the value of the returned jewelry item.
The customer bears the cost of return shipping.
In addition, the Seller may offer a one-time free adjustment in the event of fit-related issues as a voluntary service.
The customer bears the cost of return shipping.
These arrangements do not constitute a withdrawal and are voluntary goodwill services without legal entitlement.
9. Warranty
The statutory warranty rights apply.
In the event of defects, the Seller is initially entitled to provide subsequent performance.
If this fails, the customer is entitled to the statutory rights.
10. Liability
The Seller shall be liable without limitation in cases of intent, gross negligence, or injury to life, body, or health.
In cases of slight negligence, the Seller shall only be liable for breaches of essential contractual obligations and limited to foreseeable, typical damages.
11. Contract Language and Applicable Law
The contract language is German.
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
12. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution:
https://ec.europa.eu/consumers/odr/
The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Severability Clause
Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
